These Terms govern your use of toptier.lol (the "Service"), including the public list, listing pages, checkout, and email we send you. By using the Service, submitting a listing, or completing a payment, you agree to these Terms and to our Privacy Policy.
If you do not agree, do not use the Service and do not pay for a rank.
These Terms work alongside the public Rules, which describe the same mechanics in plain language. Where the Rules and these Terms conflict, these Terms control.

toptier.lol is a paid public list. You may pay to list a social media profile you own or are authorized to represent, and to occupy a position determined solely by the amount paid.
Listings are paid advertising placements. They are not editorial rankings, reviews, endorsements, certifications, awards, or independent evaluations of any kind. We do not assess quality, audience, authenticity, or the truth of anything a listing says. The amount paid for each position is displayed publicly next to it.
A payment buys a position on the list at the rank that amount reaches when the payment is confirmed. It does not buy traffic, clicks, views, followers, brand deals, revenue, customers, exclusivity, a guaranteed duration at any position, search engine ranking, or any other outcome. Someone else may pay more and take your position at any time.
We may change, pause, or discontinue any part of the Service, including categories, the rolling 24-hour board, pricing minimums, and the ranking formula.
Bids are whole US dollars, with a $5 minimum and a $999,999 maximum. Taking the top position costs at least $5 more than the current top bid; passing any other position costs at least $1 more than the bid at that position. Equal bids retain their existing order, so an earlier bid holds the higher position.
Raising your own listing costs only the difference between your current total and your new total. Your cumulative total is what defends your position; another person must exceed that total, not merely the difference you paid.
The "Today" board ranks amounts paid within a rolling 24-hour window. Each payment counts toward that window for 24 hours from confirmation and then stops counting there, while continuing to count toward your all-time total.
Completing checkout is an offer to purchase placement on these terms. Your position is assigned when payment is confirmed and your listing is published, at whatever position that amount then supports. Prices shown before payment are estimates based on the list at that moment and may change if others pay in the interim.
Payments are processed by Stripe. We do not receive or store full payment card numbers. Stripe's terms and privacy notice apply to the payment itself.
All amounts are in US dollars. Applicable sales, use, or similar taxes may be added at checkout and, where required, are collected and remitted by us.
Except as stated in this section, all payments are final and non-refundable. Placement is delivered as soon as payment is confirmed and your listing is published.
Being outbid, losing position on the Today board after 24 hours, receiving fewer clicks than you hoped, disliking your assigned category, downtime, or later removal for breaking these Terms do not entitle you to a refund.
We will refund you if we reject or remove your listing for a reason that is not attributable to you or your content. We may also issue refunds at our discretion. Issuing one refund does not obligate us to issue another.
Initiating a chargeback or payment dispute without a legally required basis is a breach of these Terms. We may remove the listing, retain evidence of the transaction, and decline to serve you in future.
You are responsible for everything you submit, including the handle, display name, description, profile image, and any other images ("Your Content").
By submitting, you represent and warrant that:
You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, resize, reformat, and publicly display Your Content in order to operate, promote, and archive the Service, including in automatically generated share images and in our own posts about the list.
This license continues while your listing is public and for a reasonable period afterward for archival and record-keeping. You continue to own Your Content. Removing a listing does not reverse a completed payment.
In addition to the Rules, you may not use the Service for:
Every listing is reviewed before it appears publicly. We may refuse, delay, edit, recategorize, hide, or permanently remove any listing, with or without notice, where we believe these Terms, the Rules, or the law may have been broken; where a rights holder or platform complains; or where a listing creates legal, security, or reputational risk.
Removal for a reason attributable to you or your content does not entitle you to a refund. Removal for any other reason does.
If you believe content on the Service infringes your copyright, send a notice to legal@toptier.lol including: your contact details; identification of the work; the listing URL; a statement that you have a good faith belief the use is unauthorized; a statement, under penalty of perjury, that your notice is accurate and you are authorized to act; and your signature.
We will respond to valid notices, including by removing content and terminating repeat infringers. Our designated agent for copyright notices is [DMCA AGENT NAME AND ADDRESS], also registered with the US Copyright Office.
For non-copyright complaints, impersonation, privacy, publicity, trademark, or an unlawful destination, email hello@toptier.lol with the listing URL and a description. We may remove or restrict a listing while we review, and may share your notice with the person who submitted it.
Platform names such as Instagram, TikTok, X, and YouTube belong to their owners. We use them only to identify where a listing points. We are not affiliated with, endorsed by, or sponsored by any of them.
toptier.lol, our wordmark, and the design of the Service are ours. You may not copy the Service, or scrape the list to build a competing ranking product.
Appearance on the list is not our opinion of any person, product, or service. We do not verify claims, audience figures, or results.
Click counts and other figures describe what our systems recorded, subject to filtering for automated traffic. They are not a promise that you will receive similar numbers. Any outcome depends on your bid, your profile, timing, and factors outside our control.
Links from the Service to listed profiles leave toptier.lol and are marked as sponsored. Those destinations have their own terms and practices, and we are not responsible for them.
The Service is provided as is. It may be unavailable, delayed, or inaccurate. We may change these Terms; if a change is material we will update the effective date and, where practical, give notice. Continued use after a change means you accept it. For a payment already completed, the Terms in effect at checkout govern that payment, except where a change is required by law or to address a security or legal risk.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that listings, names, images, positions, or click counts are accurate or complete.
To the fullest extent permitted by law, we are not liable for lost profits, lost data, lost goodwill, substitute services, or any indirect, incidental, special, consequential, or punitive damages.
Our total liability for any claim relating to a payment is limited to the amount you paid us for the listing that the claim concerns during the three months before the claim arose.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You will defend, indemnify, and hold harmless [LEGAL ENTITY NAME] and the people working on the Service from claims, damages, losses, and reasonable legal fees arising from Your Content, the profile you listed, your payment or chargeback, your breach of these Terms, or your infringement of anyone's rights. We may assume the defense of any such claim, and you will cooperate.

These Terms are governed by the laws of the State of [STATE], without regard to its conflict of laws rules. Where a mandatory consumer protection law of your home jurisdiction cannot be displaced, that law still protects you.
If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the Service. These Terms, the Rules, the Privacy Policy, and the details you confirm at checkout form the entire agreement between us regarding the Service.
